These Terms & Conditions ("Terms") are an agreement between you and UpIn Enterprise LLC, which operates My Trucking Board ("we," "us" or "our"). They cover the website at www.mytruckingboard.com, the My Trucking Board platform, the company login and driver application pages we host for our customers, and any related support and services (together, the "Service").

By creating an account, signing an order or agreement, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a company, you confirm that you are authorized to accept these Terms for that company, and "you" means both you and the company. If you have a separate signed agreement with us, that agreement controls where it conflicts with these Terms.

1. Who can use the Service

The Service is a business tool for trucking companies, their employees and their drivers. You must be at least 18 years old and able to enter into a binding contract. The Service is offered for use in the United States. If you use it from somewhere else, you are responsible for following local laws.

2. Accounts and users

Each customer company has an account and may create as many user accounts as it needs for its employees and drivers. You are responsible for:

  • Giving accurate company and user information and keeping it current.
  • Keeping usernames and passwords confidential. Each login is for one person; a user account cannot be signed in from two places at once, and logins may not be shared.
  • Everything that happens under your company's account and user accounts, including what your employees and drivers do.
  • Telling us right away at support@mytruckingboard.com or (888) 897-0123 if you suspect an account has been accessed without permission.

We may require extra verification, such as a code sent by email, when someone signs in from a new device or IP address.

3. Your right to use the Service

While your subscription is active and you follow these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service for your company's internal business operations. You may not:

  • Copy, resell, rent, sublicense or give third parties access to the Service, except your own employees, drivers and advisors working for you.
  • Reverse engineer, decompile or try to extract the Service's source code, except where the law allows it despite this restriction.
  • Get around security features, usage limits or access controls.
  • Use the Service to build a competing product, or copy its features, design or content for that purpose.

4. Sign-up, verification, free trial and setup

Verification. Sign-up asks for a USDOT number. We check that the FMCSA record shows active operating authority and that the company name and phone match. We may decline or close sign-ups that don't pass this check.

Free trial. Every new company gets the full Service for 7 days. At the end of the trial you can choose a paid plan. If you don't, your account moves to the Free plan (1 active truck, 1 user, and the features listed on the Pricing page).

Inactive Free accounts. A Free account with no sign-in for more than 6 months is considered inactive and is deleted, together with its data and files. We email the account administrator at least 30 days before deletion, so you can sign in to keep the account or export your data. Deleted accounts and data can't be restored. Paid accounts are not affected.

Free plan. Free accounts are approved by us, usually within 1 business day. Features on the Free plan may change, and new features may reach paid plans first.

Setup and move-in. On request we import your drivers, trucks, trailers, brokers and open loads from your previous system or spreadsheets at no charge. Setup times are estimates, not guarantees.

Your branding and domain. If you ask us to show your company name, logo or domain, you confirm you have the right to use them.

Training and support. Support is available Monday to Friday, 9 AM to 5 PM Central, excluding holidays. The Unlimited plan includes priority support.

5. Plans, fees and payment

  • Plans. Plans are priced by the number of active trucks: Free (1 truck), Starter (up to 10), Growth (up to 25), Fleet (up to 50) and Unlimited. Current prices are on the Pricing page. Paid plans include unlimited users and every product, with no add-ons or extra charges.
  • Active trucks. A truck counts toward your plan only while it is marked Active in the Service.
  • Growing past your plan. When your active trucks pass your plan's limit, you get 14 days at the larger plan's limit before billing changes. After that we move you to the plan that fits and tell you before we charge.
  • Billing. You can pay monthly or yearly. Yearly billing costs the same as 10 months (2 months free). Monthly plans have no long-term commitment. Subscriptions renew automatically for the same period unless you cancel.
  • Price lock. Companies that sign up on or before December 31, 2026 and start a paid plan by the end of their free trial keep the price of the plan they sign up with for 24 months from their first payment, while their subscription stays active.
  • Payment methods. We accept major credit and debit cards; after the first payment you may switch to eCheck (ACH).
  • Late or failed payments. If a payment fails or is more than 15 days late, we may suspend access after notice until the balance is paid.
  • Price changes. Except for the price lock, we may change prices with at least 30 days' notice. New prices apply at your next renewal.
  • Taxes and refunds. Fees don't include taxes. Fees already paid are non-refundable, except where the law requires otherwise.

AI document reading. Each plan includes a monthly number of AI document reads: Free 15, Starter 250, Growth 500, Fleet 1,000 and Unlimited 5,000. Unused reads don't carry over. When you reach the limit, AI reading pauses until the 1st of the next month; entering loads and documents by hand keeps working. AI results can contain mistakes, so you check them before saving.

6. Your data

You own your data. "Customer Data" means the information you, your users and your drivers put into the Service, such as loads, rates, invoices, statements, driver files, applications, equipment records, documents and messages. You keep all rights to it.

What we may do with it. You allow us to host, copy, process and display Customer Data only as needed to provide, secure, support and improve the Service for you, and as the law requires. We do not sell Customer Data. We may create anonymous, aggregated statistics that do not identify you, your drivers or any person, and use them to run and improve the Service.

Your responsibilities. You are responsible for the accuracy and legality of Customer Data, and for having the rights and consents needed to put it into the Service. This includes driver and applicant information you collect through your driver application, such as license, employment and background details. You are responsible for meeting your own legal duties as a motor carrier and employer, including FMCSA and DOT record-keeping and driver qualification rules.

Backups and restore. We keep backups so that deleted company information can generally be restored for up to the last 30 days. Backups are a safety measure, not a guarantee, and we recommend you keep your own copies of records you are legally required to retain.

Export any time. You can export all your data and files in CSV and PDF at any time, free of charge.

When you leave. For 30 days after your account ends, you may ask us at support@mytruckingboard.com for an export of your Customer Data in a standard format such as CSV or PDF. After that, we may delete it, except where we must keep it by law.

7. SMS, fax, calls and chat

The Service includes tools to send text messages, faxes and calls, and to chat with employees and drivers. When you use them:

  • You are the sender of your messages and are responsible for their content.
  • You must follow the laws that apply to calls, texts and faxes, including the Telephone Consumer Protection Act (TCPA), the Junk Fax Prevention Act, the CAN-SPAM Act, carrier rules for business texting (such as 10DLC registration) and do-not-call rules.
  • You must have the consent required by law before texting or calling anyone, and you must honor opt-out requests such as "STOP" right away.
  • You may not use these tools for spam, unsolicited marketing to people who have not agreed to it, or anything illegal or harassing.
  • Messages may be delivered through third-party telecom providers, and delivery is not guaranteed. Usage charges or limits may apply depending on your plan.

We may suspend these tools if we receive complaints, carrier warnings or signs of misuse.

8. Acceptable use

You and your users may not use the Service to:

  • Break any law or regulation, or help someone else do so.
  • Upload content that is false, fraudulent, defamatory, harassing or that infringes someone else's rights.
  • Upload viruses or harmful code, or try to disrupt, overload or attack the Service, including denial-of-service attacks.
  • Probe, scan or test the Service's security, or access accounts or data you are not authorized to access.
  • Scrape, crawl or bulk-download data with automated tools, except through exports or tools we provide.
  • Collect information about drivers, applicants or others for purposes unrelated to your trucking business, or without the consents the law requires.
  • Pretend to be another person or company.
  • Use the Service, including a Free account, for competitive analysis or benchmarking, or to build a competing product. We may close accounts that do this.

Breaking these rules may lead to suspension or termination and may also be reported to law enforcement.

9. Third-party services

The Service may work with or link to services we don't control, such as factoring companies, fuel card providers, payment processors, email and telecom providers, and mapping services. Your use of those services is governed by their own terms and privacy policies. We are not responsible for them, their content or their availability, and a link is not an endorsement.

10. Our property and feedback

We and our licensors own the Service, including its software, design, text, graphics, logos and the name "My Trucking Board." These Terms don't give you any rights to them except the limited right to use the Service in Section 3. You may not use our names or logos without our written permission.

If you send us ideas or suggestions, we may use them freely, without payment or obligation to you. This does not give us any ownership of your Customer Data.

11. Changes to the Service

We improve the Service over time and may add, change or remove features. If a change significantly reduces core functionality you rely on, we will try to give you reasonable notice. Planned maintenance may cause short interruptions; where practical we schedule it outside business hours.

12. Cancellation, suspension and termination

Cancelling. You may cancel by calling (888) 897-0123 or emailing support@mytruckingboard.com. Month-to-month plans end at the end of the current billing month. Plans with a contract term end at the end of that term unless your agreement says otherwise. We are happy to talk through any concerns before you cancel.

Suspension or termination by us. We may suspend or end your access, with notice where practical, if you don't pay, break these Terms, put the Service or other customers at risk, or if the law requires it.

Inactive Free accounts. Free accounts with no sign-in for more than 6 months are deleted as described in Section 4.

After termination. Your right to use the Service ends, and you must pay any fees owed up to the end date. Sections 6 (data export and deletion), 10, 13, 14, 15, 16 and 18 continue to apply.

13. Disclaimer

We work hard to keep the Service running, accurate and secure. However, except as stated in a signed agreement, the Service is provided "as is" and "as available," and we disclaim all warranties to the fullest extent the law allows, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free.

The Service is a management tool. It does not give legal, tax, accounting, safety or compliance advice, and alerts and reminders (for example, for expiring licenses, medical cards, inspections or insurance) are aids, not a substitute for your own compliance checks. You remain responsible for your business decisions, filings, payments and regulatory obligations.

14. Limitation of liability

To the fullest extent the law allows:

  • Neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, loads or data, even if told such damages were possible.
  • Our total liability for all claims relating to the Service or these Terms is limited to the fees you paid us for the Service in the 12 months before the event that caused the claim.

These limits don't apply to your payment obligations, your indemnity duties, or liability that cannot be limited by law. Some states don't allow certain limits, so parts of this section may not apply to you.

15. Indemnification

You agree to defend and hold harmless My Trucking Board, its owners, employees and agents from third-party claims, losses and costs (including reasonable attorney's fees) arising from your Customer Data, your messages sent through the Service, your violation of these Terms or the law, or your relationship with your drivers, applicants, brokers, shippers or other third parties. We will tell you promptly about any such claim and let you control the defense, and you may not settle a claim that imposes obligations on us without our consent.

16. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Before filing any claim, each side agrees to try to resolve the dispute informally by contacting the other in writing and allowing 30 days to work it out. If it isn't resolved, the dispute will be heard only in the state or federal courts located in DuPage County, Illinois, and both sides consent to those courts' jurisdiction. Either side may bring a qualifying claim in small claims court. Any claim must be brought within one year after it arises, unless the law requires a longer period.

17. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date and, for significant changes, notify account administrators by email or in the Service at least 30 days before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms. If you don't agree, you may cancel as described in Section 12.

18. General

  • Notices. We may send notices by email to your account administrator or through the Service. Legal notices to us must be sent by email and by mail to the address below.
  • Electronic communications. You agree to receive agreements, notices and other communications electronically.
  • Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of our business.
  • Whole agreement. These Terms, the Privacy Policy and any signed order or agreement are the entire agreement between us about the Service.
  • Severability and waiver. If a provision can't be enforced, the rest stays in effect. Not enforcing a provision is not a waiver of it.
  • Events beyond our control. Neither side is responsible for delays caused by events outside its reasonable control, such as outages of internet, power or telecom providers, natural disasters or government actions (this doesn't excuse payment obligations).
